1. Software, not legal advice
EstateWise is an estate administration software platform. It provides tools to assist professional firms and estate practitioners with administrative workflows, document management, and form generation.
Nothing on this platform, in any generated document, or in any communication from EstateWise constitutes legal, fiduciary, tax, or financial advice. EstateWise does not practise law and does not act as an attorney, fiduciary practitioner, or adviser of any kind.
2. Professional judgement required
EstateWise does not replace professional judgement. Firms and practitioners using the platform are responsible for applying their own expertise, verifying all information, and obtaining appropriate legal, tax, or financial advice for the estates they administer.
3. EstateWise is not the Master's Office
EstateWise is a private software company. We are not affiliated with, endorsed by, or acting on behalf of the Master of the High Court or any South African government authority. EstateWise has no authority to accept, approve, or reject estate administration filings.
4. No lodgement of original documents
EstateWise does not lodge original wills, estate documents, or forms with the Master of the High Court or any other authority. The platform generates administrative documents as aids to estate practitioners. Users and their appointed practitioners remain solely responsible for all formal filings, submissions, and lodgements.
5. User and firm responsibility
Users and professional firms are responsible for:
— Verifying the accuracy and completeness of all information entered into the platform.
— Checking that generated forms are correct, complete, and suitable for the specific estate and authority before any submission.
— Complying with the Administration of Estates Act 66 of 1965, POPIA, and all other applicable legislation and professional rules.
— Obtaining professional legal, tax, fiduciary, or other specialist advice where required.
6. Generated documents
Forms and documents generated by EstateWise are provided as administrative aids based on data entered by the user. EstateWise does not verify the accuracy of data entered. The acceptance of any generated document by the Master's Office, a court, financial institution, or any other authority is not guaranteed.
7. Accuracy and availability
EstateWise aims to maintain accurate and up-to-date functionality but does not warrant that the platform is error-free, uninterrupted, or that outputs will meet the requirements of any specific authority at any given time. Form requirements may change and may not always be reflected immediately in the platform.
8. Limitation of liability
To the fullest extent permitted by applicable South African law, EstateWise and its directors, employees, and contractors are not liable for any loss, damage, or claim arising from: reliance on generated documents or platform outputs; errors or omissions in data entered by users; non-acceptance of documents by any authority; or unavailability of the service. Users accept these limitations when using the platform.
